• Service refers to the Website.
• Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
• Website refers to All Season Pools & Spas, accessible from https://www.allseasonspools-spas.com/
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the company’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Loyalty Program

This All Seasons Pools and Spas Rewards Program (the “Loyalty Program”) operates under the terms and conditions as set forth below (the “Program Rules”). The Program Rules govern All Seasons Pools and Spas relationship with members of the Loyalty Program (collectively, “Members, ” and individually, a “Member” or “you”), including how Members manage their accounts, earn and redeem Points and Rewards.

PLEASE READ THESE PROGRAM RULES CAREFULLY . BY ACCESSING OR PARTICIPATING IN THE LOYAL TY PROGRAM, YOU AGREE TO BE BOUND BY THESE PROGRAM RULES AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE PROGRAM RULES, DO NOT ACCESS OR PARTICIPATE IN THE LOYAL TY PROGRAM.

You agree that we may provide updates, notices, disclosures and amendments to these Program Rules, and other information relating to the Loyalty Program by electronic means, including posting such information and materials online at No purchase is necessary to enroll for membership in the Loyalty Program.

An individual may apply to enroll in the Loyalty Program by fully and accurately providing the applicable information on the Loyalty Program website, or in-store. First name, last name and an email address are required for membership and in order to access your Loyalty Program account (the “Account”). Information provided by a Member will be maintained in a personal preference profile with the Account.

Individuals who are 18 years of age or older (or the age of majority in your jurisdiction, if higher) may enroll for membership in the Loyalty Program. Loyalty Program participation is for All Seasons Pools and Spas Residential customers only. Commercial customers and pool trade professionals are not eligible to participate.

All Seasons Pools and Spas may deny enrollment in the Loyalty Program to any applicant in its sole discretion and with or without written notice.

By opening an Account and by using the Account you were assigned to receive and redeem benefits of the Loyalty Program, including, without limitation, Points and Rewards (as defined below), you agree that:

• You have read and accept these Program Rules; and you have read and accept All Seasons Pools and SpasTerms and Conditions which are incorporated by reference herein;
• You consent to the collection, use, and disclosure of your personal data by All Seasons Pools and Spas and the Loyalty Program, and authorized third-party agents and licensees, in accordance with All Seasons Pools and Spas Privacy Policy which are incorporated by reference herein and which you confirm you have read;
• You are solely responsible for reading the Program Rules, All Seasons Pools and Spas newsletters or communications, and Account statements in order to understand your rights, responsibilities, and status in the Loyalty Program, as well as the structure for earning Points and Rewards; and
• You have not been previously suspended or removed from the Loyalty Program, or engaged in any activity that could result in suspension or
• removal from the Loyalty Program.

Loyalty Benefits

Earned Points and Rewards

Loyalty Program points (“Points”) will accrue at the rate of one (1) Point per $1.00 spent at any All Seasons Pools and Spas retail location,excluding taxes, donations, purchases of gift certificates, and value of coupons. Points are automatically added to your Account within two (2) business days from your purchase date, shipment date or pick-up date. Points expire twelve (12) months after the calendar date in which such Points were added to your Account.

Each accrual of one hundred (100) earned Points earns the equivalent of $5 in Rewards. Rewards denominations include, $5, $10, $20, $50, and $100. Rewards may be used for dollars off any qualifying purchase at any All Seasons Pools and Spas retail location. Rewards are coupons for discounts on future qualifying purchases. The oldest accrued Points will be used first for Rewards issuance. Points earned convert into Rewards within 24 hours of the accrual of the points.

Points can be accrued through one purchase or multiple purchases made over the course of the Member’s participation in the Loyalty Program.

Rewards expire twelve (12) months after the calendar date in which such Rewards were issued.

Your Points and Rewards balances are available for you to view online. Members can access their online Account or learn more about the Loyalty Program at https:/ /allseasonspoolsandspas.marsello.app/. We may identify certain products and offers which are ineligible to earn Points or use Rewards. Any refillable/returnable products are excluded from eligible percentage off discounts, as are disposable Sodium Hypochlorite and Muriatic Acid.

If a Member believes his or her eligible purchase was incorrectly applied toward earning Points, they should contact Customer Care by emailing loyalty@allseasonspools-spas.com Points may also be earned for engaging in non-purchase related behavior, such as liking and following on social media, , or through special offerings and other activities, as determined in the sole discretion of All Seasons Pools and Spas. Point increments can vary at All Seasons Pools and Spas discretion.

VIP Tiers

All Seasons Pools and Spas offers two tiers of VIP Loyalty perks. Tier 1 begins at an annual spend of $500 (pre tax) and Tier 2 begins at an annual spend of $8,000 (pre tax).

Tier 1 VIP grants access to a 5% discount for in-store purchases of pool and spa chemicals. This percentage off discount is not applicable to refillable items, container deposits, or to disposable cases of sodium hypochlorite or muriatic acid. This discount is not applicable to warrantied items or equipment, their replacement parts, services or freight. This includes but is not limited to: Pools and Spas, Liners, Covers,Pool Sweeps, Pool Robots, Pool pumps, heaters, filtration systems, heating or cooling equipment, parts and services. This may be combined with Earned Rewards but may not be combined with any other offer or discount.

Tier 2 VIP grants access to a 10% discount for in-store purchases of pool and spa chemicals. This percentage off discount is not applicable to refillable items, container deposits, or to disposable cases of sodium hypochlorite or muriatic acid. This discount is not applicable to warrantied items or equipment, their replacement parts, services or freight. This includes but is not limited to: Pools and Spas, Liners, Covers, Pool Sweeps, Pool Robots, Pool pumps, heaters, filtration systems, heating or cooling equipment, parts and services. This may be combined with Earned Rewards but may not be combined with any other offer or discount.

Tier 1 VIP will expire and revert to a standard membership after one calendar year if annual purchase amount falls below the minimum annual spend

Tier 2 VIP will expire and drop to tier 1 VIP after one year if annual purchase amount falls below the minimum annual spend. IF Tier 2 VIP status is reached via the purchase of a new spa, your Tier 2 VIP status can be restored at your request for the duration of the time you own the spa. Proof of purchase may be required.

Gift Rewards

There is no purchase necessary for Gift Rewards. They are issued at the sole discretion of All Seasons Pools and Spas in varying denominations and expiration dates.

Gift Rewards are one-time use. Member will not receive any cash back or store credit for the remainder of the Gift Reward in excess of the purchase price, and this remainder will be forfeited.

Gift Rewards may be used for dollars off any qualifying purchase at All Seasons Pools and Spas retail store. Rewards are coupons for discounts on future qualifying purchases.

Gift Rewards may be applied to all purchases and services after any other coupons/discounts have been applied. Some exclusions apply. See store associates

Gift Rewards cannot be redeemed in full or in part for cash, gift certificates or store credit. Gift Rewards hold no cash value.

Gift Rewards expiring soonest will be redeemed first.

Rewards Redemption

In the event a total purchase price is less than the Member’s accrued Earned Reward balance, the last reward redeemed will be decremented by the amount used toward the purchase and the remaining balance of the reward will remain with the original expiration date.

In the event a total purchase price is less than the Member’s Gift Reward balance, the remaining balance of the Gift reward will be forfeited.

Rewards are redeemed to the penny of the rewards balance.

Rewards cannot be redeemed in full or in part for cash, gift certificates, store credit, or federal, state, or local taxes. Points and Rewards hold no cash value.

All Seasons Pools and Spas is not responsible for lost or stolen Points or Rewards.

Rewards will be applied to all purchases and services at the point of sale after any other coupons/discounts have been applied. Some exclusions apply. See store associates for details.

General Terms

Changes and Modifications

All Seasons Pools and Spas reserves the right to change or modify this Loyalty Program at any time in its sole discretion.

Any changes or modifications to this Loyalty Program will be effective immediately and may be posted to , so please check back from time to time. You waive any right you may have to receive specific notice of such changes or modifications, and your continued access to or participation in Loyalty Program following any such changes or modifications confirms your acceptance. If you do not agree to these Program rules, you must stop accessing and participating in Loyalty Program.

Miscellaneous

These Program Rules, together with any other documents incorporated herein by reference and otherwise made available to a Member in connection with Loyalty Program, constitutes the sole and entire agreement of the parties with respect to the subject matter of these Program Rules and supersedes all prior and contemporaneous understandings, agreements, and representations and warranties with respect to such subject matter.

If any provision of these Program Rules is deemed invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability will not affect any other term or provision of these Program Rules.

The Loyalty Program and these Program Rules are governed by and construed in accordance with the internal laws of the State of California without regards to its conflicts of laws provisions.

The failure of All Seasons Pools and Spas to require Member’s strict performance of any term of these Program Rules shall not be a waiver of the right of All Seasons Pools and Spas to require strict performance of any term or condition herein.

All Seasons Pools and Spas shall not be liable for any delay, interruption, or failure of the Loyalty Program, or any loss, liability or damage directly or indirectly caused by circumstances beyond the control of All Seasons Pools and Spas , including but not limited to acts of God, flood, explosion, computer or network malfunction, or similar circumstances.
